It entered into force on 26 March 2024 and becomes applicable on 27 September 2026.<\/p>\n<p>It forms part of the European Green Deal and amends two existing directives:<\/p>\n<ul>\n<li>The <strong>Unfair Commercial Practices Directive<\/strong> (UCPD, 2005\/29\/EC) \u2014 the EU&#8217;s central standard against misleading advertising<\/li>\n<li>The <strong>Consumer Rights Directive<\/strong> (CRD, 2011\/83\/EU) \u2014 the standard governing pre-contractual information obligations<\/li>\n<\/ul>\n<p>EmpCo is therefore not a standalone new law, but a sharpening of existing consumer law. This has two important practical consequences: first, the enforcement mechanisms are already established (competition watchdogs, consumer associations, competitor litigation). The directive makes no exception for marketing communications or packaging produced before 27 September 2026. Existing products and legacy content must also be compliant by the deadline.<\/p>\n<\/div>\n<h2 id=\"scope\">Who is affected?<\/h2>\n<p>The directive applies to all commercial communications directed at consumers in the EU \u2014 regardless of industry, company size or the location of the business. Specifically affected are:<\/p>\n<ul>\n<li>Businesses in all sectors selling products or services to end consumers in the EU<\/li>\n<li>Manufacturers whose products reach consumers through retailers<\/li>\n<li>Brand owners with consumer-facing brand communications<\/li>\n<li>Companies headquartered outside the EU, as soon as they target EU consumers<\/li>\n<li>B2B suppliers, to the extent that their claims feed into end-consumer communications<\/li>\n<\/ul>\n<h3>The most common misconception: SME exemptions<\/h3>\n<p>Many sources mention SME exemptions \u2014 extended transition periods or simplified documentation requirements. However, these exemptions relate to the still-pending Green Claims Directive (see the distinction section below), not to EmpCo itself.<\/p>\n<p><strong>There are no size-based exemptions under the Empowering Consumers Directive.<\/strong> The core prohibitions apply from 27 September 2026 to all businesses \u2014 regardless of headcount or turnover. Enforcement bodies do not distinguish by company size in practice.<\/p>\n<h3>What about purely B2B communications?<\/h3>\n<p>The directive targets B2C communications. Purely B2B materials \u2014 such as technical data sheets for business customers, internal sales documents, and access-restricted B2B portals \u2014 do not fall directly within the scope. However:<\/p>\n<ul>\n<li>If B2B content is publicly accessible (freely downloadable whitepapers, open data sheets), it can reach consumers and therefore fall under EmpCo<\/li>\n<li>Where B2B-origin claims are reused or transferred into consumer-facing (B2C) marketing materials, they are subject to EmpCo requirements<\/li>\n<li>Even where EmpCo does not directly apply, general unfair competition law and its prohibition on misleading statements continues to apply<\/li>\n<\/ul>\n<h2 id=\"prohibitions\">The key prohibitions at a glance<\/h2>\n<p>The directive introduces several new per se prohibitions, which are added to the &#8220;blacklist&#8221; of prohibited commercial practices. Per se prohibitions mean: no individual assessment of whether something is misleading is required \u2014 the practice is automatically unlawful. This makes them particularly easy for enforcement bodies to act on.<\/p>\n<div class=\"prohibition-grid\">\n<div class=\"prohibition-item\">\n<div class=\"prohibition-num\">1<\/div>\n<div class=\"prohibition-content\">\n<h4>Generic environmental claims without substantiation<\/h4>\n<p>Terms such as &#8220;eco-friendly&#8221;, &#8220;green&#8221;, &#8220;natural&#8221;, &#8220;ecological&#8221;, &#8220;climate-friendly&#8221;, &#8220;sustainable&#8221; are only permissible if the same medium concretely and verifiably explains what the claim relates to. References to external websites or QR codes are not sufficient.<\/p>\n<\/div>\n<\/div>\n<div class=\"prohibition-item\">\n<div class=\"prohibition-num\">2<\/div>\n<div class=\"prohibition-content\">\n<h4>Carbon neutrality claims based on offsetting<\/h4>\n<p>Terms such as &#8220;carbon neutral&#8221;, &#8220;CO\u2082-neutral&#8221;, &#8220;climate-compensated&#8221; are prohibited from the deadline if they rest on offsetting measures outside the value chain. Only claims based on actual reductions remain permissible.<\/p>\n<\/div>\n<\/div>\n<div class=\"prohibition-item\">\n<div class=\"prohibition-num\">3<\/div>\n<div class=\"prohibition-content\">\n<h4>Sustainability labels without a recognised certification scheme<\/h4>\n<p>Own-brand labels without third-party verification are prohibited from the deadline. Only labels based on a certification scheme with independent oversight \u2014 or established by a public authority \u2014 are permissible.<\/p>\n<\/div>\n<\/div>\n<div class=\"prohibition-item\">\n<div class=\"prohibition-num\">4<\/div>\n<div class=\"prohibition-content\">\n<h4>Future promises without an implementation plan<\/h4>\n<p>Claims such as &#8220;carbon neutral by 2030&#8221; are only permissible if a detailed, publicly accessible and verifiable implementation plan exists \u2014 with measurable interim targets, resource allocation and regular third-party review.<\/p>\n<\/div>\n<\/div>\n<div class=\"prohibition-item\">\n<div class=\"prohibition-num\">5<\/div>\n<div class=\"prohibition-content\">\n<h4>Whole-product claims when only part qualifies<\/h4>\n<p>&#8220;Made from recycled material&#8221; may not be used if only the packaging is recycled.
